US President Donald Trump’s tariffs are unconstitutional, but they can remain in place for now, a US appeals court has ruled.
The court ruled that the US president did not have the legal authority to declare emergencies and impose import tariffs against almost all countries, while generally upholding the verdict of a specialized federal trade court, writes Sky News .
But appeals judges delayed implementation of their ruling until mid-October, allowing the tariffs to remain in effect so the administration could appeal the case to the Supreme Court.
The American leader, for his part, commented on the decision, stating that all tariffs are still in effect. “If these tariffs were ever to disappear, it would be a complete disaster for the country. It would make us financially weak, and we should be strong. The United States will no longer tolerate huge trade deficits and unfair tariff and non-tariff barriers imposed on us by other countries – whether friends or foes – that undermine our producers, farmers and everyone else,” he wrote in Truth Social .
The court’s ruling could limit the speed and scope of Trump’s actions, despite his having alternative laws to impose import tariffs. In a legal filing this month, the Justice Department warned that repealing the tariffs could mean “financial ruin” for the United States.
