The Grand Chamber of the European Court of Human Rights has announced its decision in the interstate case “Ukraine and the Netherlands v. Russia.” It recognized numerous human rights violations by the Russian Federation.

Thus, the President of the ECHR, Matthias Guillaumar, announced that there were violations of Articles 2 and 13 in the case of the downing of flight MH17.
The Court also ruled unanimously that the suffering of the relatives of the MH17 victims fell within the scope of Article 3 of the Convention (prohibition of inhuman or degrading treatment). Other applications found violations of the European Convention on Human Rights, in particular Articles 2-5, 8-11, 13 and 14 – the right to life, the prohibition of torture, freedom of expression, peaceful assembly, freedom of conscience and a number of others.
The case brings together four claims and covers events in eastern Ukraine involving pro-Russian separatists that began in 2014, including the downing of Malaysia Airlines flight MH17, as well as the invasion of Ukrainian territory by Russian troops since 2022.
Recall that the passenger Boeing-777 of “Malaysia Airlines”, operating flight MH17 from Amsterdam to Kuala Lumpur, crashed over the temporarily occupied part of the Donetsk region on July 17, 2014. There were 298 people on board the airliner, all of whom died.
On November 17, 2022, the Hague court found Russian terrorist Igor Girkin (Strelkov), General of the GRU of the General Staff of the Russian Armed Forces, Head of the “GRU of the DPR” Sergei Dubinsky, and Ukrainian citizen Leonid Kharchenko guilty of shooting down flight MH17 and killing 298 people, and sentenced them to life imprisonment.
