Drunk judge to be detained throughout investigation after killing soldier in traffic incident

The High Council of Justice has approved the detention of Oleksiy Tandyr, the Makariv District Court head involved in a deadly road incident in Kyiv, Suspilne TV reported on May 27.

An intoxicated Tandyr ran over and killed a 23-year-old National Guard soldier at a checkpoint in Kyiv late on May 25, media reported.

The judge was detained for violating of the rules of road safety or operation of transport in a state of alcoholic, narcotic or other intoxication, which caused the death of the victim (part 3 article 286-1 of the Criminal Code of Ukraine).

The judge denied that he was drunk and said he wasn’t aware of how a bottle of alcohol appeared in his car.

“Maybe, it has been left from the past,” he said.

Tandyr didn’t deny his involvement in the incident and declared his readiness to bear responsibility if his guilt is proven. The judge’s lawyer stated that he did not refuse to provide biological samples. The prosecutor clarified that Tandyr voluntarily took only a part of the tests and the results are still pending.

The judge will be held in custody for the duration of the investigation, reported Suspilne.

The Kyiv City Prosecutor’s Office reported earlier that biological samples were forcibly taken from the judge.

  1. “The judge denied that he was drunk and said he wasn’t aware of how a bottle of alcohol appeared in his car.”

Let’s hope someone was doing their job correctly, and took fingerprints from the bottle, and this judge.

  2. Even if he can somehow prove he was sober, and also satisfactorily explain the bottle of alcohol, that would indicate MORE shame. Being sober means having more control over his reactions in driving, which means that barring some kind of mechanical or other sort of failure with his car, if he denies being drunk, that’s even worse!

I imagine that unpleasant as his night in jail will be, he ought to examine what led him to this, and what ELSE he could have done to avoid it.

  3. In one of the earlier articles in appears that there is a bullet hole is the driver’s side of the windshield. I’m pretty certain the ARNG was yelling and waving before that. The soldier’s body was DRAGGED several yards . If the so called judge was sober during this, he deserves way more than 10 years which I gather may be like involuntary manslaughter. Am a little confused that previous article(s) said soldier was beaten to death. I hope investigation paid/pays great attention to detail.
