Deputies propose to grant voluntary formations the status of legal entities

The status of a legal entity will allow voluntary formations of territorial communities (DFTG) to open bank accounts, which will simplify their financing and support.

This is stated in the explanatory note to draft law No. 7578-1 dated July 25.

It is noted that since the beginning of the full-scale invasion of the Russian Federation, in accordance with the Law of Ukraine “On the Foundations of National Resistance”, voluntary formations of territorial communities began to form en masse in Ukraine. As of today, the number of members of the DFTG is more than 100,000 people, who on a permanent basis perform the tasks of territorial defense, in particular, take part in combat operations, protect public order and infrastructure objects, are on duty at checkpoints and participate in training the population.

At the same time, there are significant gaps in the legislation that may lead to difficulties in the further effective functioning of the DFTG.

Thus, the current legal norms do not provide for the possibility of acquiring the status of legal entities of DFTG, which is an obstacle in ensuring a sustainable process of their financing, since it is impossible to open a bank account. Under these conditions, the application of a different order of payments, in particular through the accounts of the military unit of the Territorial Defense Forces, the accounts of military administrations or local councils, is quite problematic, time-consuming and quite often simply impossible, which makes it much more difficult for volunteer formations to fulfill their tasks.

Until now, the vast majority of DFTG support themselves independently, as well as at the expense of volunteers, benefactors and, to a lesser extent, local self-government bodies. Accordingly, the deputies propose to settle the issue of the legal status of such formations.

In addition, it is proposed to introduce such a normative act as the Regulation (statute) of the DFTG, which is approved by the Command of the Terrodefense Forces of the Armed Forces of Ukraine and should contain information about the structure of volunteer formations; the territory within which they carry out their activities; rights and duties of the commander and members of volunteer formations and other issues of the DFTG activity.

People’s deputies also note that although, according to the current legislation, members of the DFTG, during their participation in the preparation and execution of territorial defense tasks, have the same guarantees as military personnel, at the same time, there are some legislative gaps regarding their provision in accordance with labor legislation.

Accordingly, it is proposed to supplement Article 119 of the Labor Code of Ukraine with a mention of members of the DFTG, which provides for the preservation of employees called up for military service during a special period of work and position at the enterprise.

    This force serves a very valuable purpose for Ukraine, being a good and substantial augmentation to the regular armed forces, border, national guard and police forces. This measure is good to increase their integration with the government.
