President of Ukraine Volodymyr Zelensky has vetoed a law on resuming the work of the High Qualifications Commission of Judges .

The proposals to the bill state that according to the law, the High Qualifications Commission of Judges of Ukraine consists of sixteen members, eight of whom are appointed from among judges or retired judges (paragraph five of item 6 of section I). At the same time, the High Qualification Commission of Judges of Ukraine is considered authorized provided that at least eleven members are appointed to its membership.

The President notes that given the need to approve the principle of judicial independence, taking into account the status and powers of the High Qualifications Commission of Judges of Ukraine, it is important to ensure proportional representation of members of the High Qualifications Commission of Judges appointed from among judges or retired judges. High Qualification Commission of Judges of Ukraine, but also in determining its authority.

The President notes that the law contains contradictions concerning the activities of the first composition of the Tender Commission and the involvement of additional experts and specialists proposed at its request by international and foreign organizations, which in accordance with international or interstate agreements during the last five years provide Ukraine with international technical assistance in the field of judicial reform and / or prevention and combating corruption.

Zelensky proposes to determine that the High Qualifications Commission of Judges of Ukraine is considered to be authorized provided that at least eleven members are appointed to it, at least six of whom are appointed from among judges or retired judges.
