PGO confirms ex-Berkut riot policemen on prisoner exchange lists

Ukrainian Prosecutor Serhiy Kutsy has confirmed that former Berkut special forces officers accused of killing rally holders near Maidan (Independence Square in Kyiv) are on the exchange lists, the online edition of Hromadske.ua reports.

Prosecutors are asking to change the measure of restraint for former Berkut members, since they are on the exchange lists.

Kutsy during a court hearing read out a letter from the Prosecutor General Ruslan Riaboshapka in which he demands the release of the accused from pretrial detention centers.

Consideration of a complaint by the defense of ex-Berkut members Pavlo Abroskin, Serhiy Zinchenko, and Oleh Yanishevsky, accused of shooting protesting participants during the Revolution of Dignity on Instytutska Street on February 20, 2014 to extend his detention, has been ongoing for more than five hours at the Kyiv Court of Appeal.

As reported, on December 19, the preventative measure against former Berkut special forces officer in the same case, Oleksandr Marynchenko, was changed to round-the-clock house arrest from pretrial detention.

On July 16, 2019, the Sviatoshynsky District Court of Kyiv released under house arrest one more suspect in the murder of 48 protesters on Maidan, former Berkut member Serhiy Tamtur.

On February 16, 2016, the court combined the proceedings against five Berkut members Abroskin, Zinchenko, Marynchenko, Tamtura and Yanishevsky. All five are accused of killing 48 protesters during the Revolution of Dignity.

On December 23, Hromadske, citing its sources, said the Ukrainian side plans to transfer as part of the exchange of persons held by the ORDLO former Berkut members accused of shooting people in central Kyiv on February 20, 2014.

    • Looks that way, and family members of the heavenly hundred are already asking for mass protests. Zelensky broke so many laws to let these murderers go to Russia, if anyone should be impeached it’s him.

    • Former Berkut law enforcers, who were earlier released from custody, stay in Donbas for the exchange with occupied Donbas as Hromadske reported citing lawyer Ihor Varfolomeev.

      • First 25 Ukrainians were released from the captivity within the prisoners’ exchange as 112 Ukraine reported.

        The swap has begun with the pass of 25 Ukrainians from the side of occupied Donbas. They will be taken to Kramatorsk after the exchange and then to Boryspil.

  4. “In this situation, there is no single obviously correct human choice. We understand that this decision by the authorities, at the request of the Kremlin, undermines the values ​​of the rule of law, justice and dignity and can divide society by sowing hatred between different groups of Ukrainians,” the statement read.

    “ When society faces this difficult choice, justice must be protected by an independent arbitrator – the court and the prosecutor’s office. Unfortunately, neither the court nor the prosecutor’s office were able to fulfill their constitutional duty in the case of the executions of Heavenly Hundred Heroes,” it continued.

    The Kyiv Court of Appeal on Dec. 28 released from custody five former police officers of the now disbanded Berkut unit who had been charged with the alleged murder of protesters during the 2013-2014 EuroMaidan Revolution.

    About 100 demonstrators were killed during the revolution, which ousted ex-President Viktor Yanukovych, and Berkut officers are accused of the worst violence.

    The release appears to be part of a planned prisoner exchange with Russia and its proxies in the eastern Donbas region. That swap may take place between Kyiv and Russia-backed militants on Dec. 29.

The deadline would be until December 31, 2019. President promised that by the end of 2019, 72 political prisoners could return to Ukraine.

    The men included on the exchange list by Donbas militants told why they do not want to go to the territory uncontrolled by Ukraine as PavlovskyNews reported.

    Following the reporter’s lead why a man put on the list refused to go to occupied Donbas, he answered:

    “We were included on the list but we refused. Families are here, everything is here and there is nothing,” a man answered.

    According to him, he does not know why the militants included him on the exchange list.

    A few people who refused from the exchange with occupied Donbas did not want to communicate with the journalist.

    “Look, bugger off. Alright? Frankly, I don’t feel like it at all. Come on, man, please”,” one of them said.
